1. Universal Terms & Right to Modify

By accessing PixMotion, you agree to these Terms. PixMotion reserves the unilateral right to modify these Terms at any time. Your continued use of the service after changes are posted constitutes your absolute acceptance of the new Terms. We also reserve the right to terminate or suspend any account at our sole discretion, without notice or liability, for any reason whatsoever.

2. Intellectual Property & Content License

User Content: You grant PixMotion a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid-up, and sub-licensable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute your content for any purpose. This includes the right to use your content for AI training and service promotion without any compensation to you.

Proprietary Technology: All software, shaders (Unity/Metal), algorithms, and UI/UX designs are the exclusive property of PixMotion. Any unauthorized copying, reverse-engineering, or data scraping is a material breach and will result in immediate legal action.

3. Absolute Disclaimers & Service Availability

Maintenance & Downtime: PixMotion does not guarantee 100% uptime. We reserve the right to interrupt, suspend, or terminate the service for maintenance, updates, or any other reason without prior notice. We are not liable for any damages resulting from such interruptions.

User Interactions: PixMotion is not responsible for the conduct of any user. We do not mediate disputes between users. You interact with other users at your own risk.

4. Fees, Payment, and Strict No-Refund Policy

Pricing & Billing: Prices are displayed in-app. All payments are processed via third-party providers. By providing payment information, you authorize us to charge the specified fees.

No Refunds: ALL SALES ARE FINAL. Due to the digital nature of our services, no refunds, returns, or credits will be issued for partially used periods, account deletions, or service dissatisfaction once the payment is completed.

5. Indemnification

You agree to indemnify, defend, and hold harmless PixMotion, its founders, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the service or your violation of these Terms.

6. Limitation of Liability

Zero Indirect Damages: Under no circumstances shall PixMotion be liable for any indirect, incidental, consequential, or punitive damages (including loss of profits, data, or goodwill).

Hard Liability Cap: Our total liability for any claim shall not exceed the total amount paid by you to PixMotion in the three (3) months preceding the claim. If no fees were paid, our liability is capped at $0.

7. Governing Law & Exclusive Jurisdiction

These Terms are governed by the laws of Japan. Any and all disputes shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.

1. Information Collection and Consent

We collect information to provide, secure, and improve PixMotion. By using the Service, you expressly consent to the collection and use of:

• Account Data: Name, email, profile imagery, and authentication logs.
• User Content: Any videos, photos, and metadata (including location tags and EXIF data) you upload.
• Technical & Usage Data: IP addresses, device identifiers, browser types, and behavioral data.
• Cookies & Tracking: We use cookies and similar technologies to track activity and maintain your session.

2. Purposes of Data Processing

We use your data for the following purposes:

• To operate and personalize the Service (including AI-driven recommendations).
• To protect PixMotion from fraud, scraping, and unauthorized access.
• To perform analytics and optimize our video processing technology.
• To comply with legal obligations and enforce our Terms of Service.

3. Global Data Transfer & Cloud Infrastructure

You acknowledge and agree that your information will be stored and processed on global cloud infrastructure (including but not limited to AWS and VPS nodes in Japan and other regions). You waive any objections to your data being transferred across international borders.

4. Third-Party Disclosure & Non-Liability

Service Providers: We share data with third-party vendors (analytics, hosting, payment processors like Stripe) who assist in our operations.

Third-Party Links: PixMotion may contain links to external sites. We are not responsible for the privacy practices, content, or data handling of any third-party services. Use of such services is at your own risk.

Legal Necessity: We reserve the right to disclose your data to law enforcement or in litigation if we believe it is necessary to protect our legal rights or the safety of others.

5. Data Retention & Deletion

Retention Policy: We retain your data for as long as your account is active or as needed to provide the Service.

Post-Deletion: Even after account deletion, we may retain certain data (including cached content and logs) for up to 90 days for security audits, or longer if required by law or to protect our legal interests in potential disputes.

Public Content: Content shared to public boards or re-shared by other users may remain visible on the platform even after your account is deleted.

6. User Rights (GDPR / CCPA / APPI)

Users in certain jurisdictions have rights to access, port, or request deletion of their data. However, we reserve the right to charge a reasonable fee or deny requests that are manifestly unfounded, excessive, or jeopardize the rights of others.

7. Security Disclaimer

We implement industry-standard security measures (encryption, secure SSH protocols) to protect your data. However, no system is impenetrable. You acknowledge that PixMotion is not liable for unauthorized access resulting from circumstances beyond our control.
